TERMS AND CONDITIONS

DEFINITIONS

Buyer” means the person or company who accepts a quotation from Isle Building Supplies for the sale of goods, or whose order for goods is accepted by Isle Building Supplies.

Conditions” means the standard terms of sale set out in this document, including any special terms agreed in writing between the Buyer and Isle Building Supplies.

Contract” means the agreement for the sale and purchase of the Goods in accordance with these Conditions.

Goods” means the products supplied by Isle Building Supplies under these Conditions.

Order” means any written request from the Buyer for the supply of Goods.

Quotation” means any written or electronic document issued by Isle Building Supplies outlining the Goods and pricing.

THE CONTRACT

1. Isle Building Supplies agrees to sell, and the Buyer agrees to purchase, the Goods in accordance with any accepted Quotation and these Conditions. These Conditions shall apply to the Contract to the exclusion of any other terms.

2. No variation to these Conditions shall be binding unless agreed in writing by authorised representatives of both the Buyer and Isle Building Supplies.

3. Employees or representatives of Isle Building Supplies are not authorised to make any representations about the Goods unless confirmed in writing.

4. Any advice or recommendation given by Isle Building Supplies or its employees regarding storage, application, or use of the Goods is followed entirely at the Buyer’s own risk unless confirmed in writing.

5. Isle Building Supplies shall not be liable for any clerical or administrative errors in quotations, price lists, invoices, or other documents, and reserves the right to correct such errors.

6. Isle Building Supplies shall not be liable for any delay or failure to perform its obligations due to events beyond its reasonable control, including but not limited to:

Acts of God, fire, flood, or accident
War, civil unrest, or terrorism
Industrial disputes or strikes
Power failure or machinery breakdown

ORDERS

1. The Buyer is responsible for ensuring the accuracy of all Order details and for providing all necessary information relating to the Goods.
2. The quantity, quality, and description of the Goods shall be as set out in the Quotation.
3. Isle Building Supplies reserves the right to make changes to specifications where required by law or where substitutions are necessary, provided this does not materially affect quality or performance.

WARRANTIES
1. Isle Building Supplies does not provide warranties on Goods unless explicitly stated. Any warranties are provided by the manufacturer or third-party supplier and are subject to their terms.
2. Where statutory rights apply and cannot be excluded, Isle Building Supplies’ liability will be limited (at its discretion) to:
Replacement of the Goods
Supply of equivalent Goods
Repair of the Goods
Payment of the cost of replacement or repair

PRICE
1. The price of the Goods shall be as quoted or as listed on the Isle Building Supplies website.
2. All quotations are valid for 30 days unless stated otherwise.
3. Isle Building Supplies reserves the right to adjust prices to reflect increases in costs beyond its control, including changes requested by the Buyer.
4. Pallets and returnable containers may be charged in addition but will be credited if returned in good condition to an agreed location. Collection may incur additional charges.

PAYMENT
1. Unless otherwise agreed in writing, invoices on account are payable within 30 days from the invoice date.
2. If payment is not made on time, Isle Building Supplies reserves the right to:
Suspend or cancel further deliveries
Allocate payments across accounts as deemed appropriate
Charge interest under the Late Payment of Commercial Debts (Interest) Act 1998
Recover reasonable costs of debt collection, including legal fees
Apply a charge of up to 25% for third-party recovery services

COLLECTION
Goods are to be collected by the Buyer from Isle Building Supplies or an agreed location once the Buyer has been notified they are ready.

DELIVERY
1. Delivery dates are estimates only and not guaranteed unless agreed in writing.
2. Isle Building Supplies is not liable for delays in delivery.
3. If the Buyer fails to accept delivery or provide adequate instructions, Isle Building Supplies may store the Goods and charge for storage and redelivery.

CANCELLATION
1. Orders accepted by Isle Building Supplies may not be cancelled without prior written agreement.
2. If cancellation is agreed, the Buyer must fully indemnify Isle Building Supplies against all losses, including loss of profit, labour, materials, and associated costs.
3. Under the Consumer Contracts Regulations 2013:
Cancellation rights do not apply to bespoke or perishable Goods
Where applicable, cancellation must be made within 7 days of ordering
Cancellation must be made in writing
4. If Goods have already been delivered:
The Buyer is responsible for return costs
Goods must be returned undamaged
Isle Building Supplies may charge for recovery if Goods are not returned properly
